Reserving A Car

We are happy to take a reservation of a car through our website for £100.

Once reserved the car will be taken off sale and held for you to the date you have asked to come to view etc.

If for some reason the car is not what you thought or described when you have viewed the car then we will be happy to refund you the £100 ( less £5.00 admin fee) .

Should you not turn up on the date to view the car then the Reservation Fee will not be refunded.

Please don’t reserve a car if you have no intention of purchasing it

Terms and Conditions of Aspire Vehicles Ltd Reservation Fee

1. Definitions In these terms, unless the context requires otherwise, the following definitions apply:-
a. "Appointment" means the appointment to view the Vehicle in accordance with Clause 7;
b. "Aspire Vehicles Ltd" means one of the motor vehicle dealerships owned and operated by Aspire Vehicles Ltd including but not limited to those trading as Aspire Vehicles Ltd which are listed on WWW. Aspire-vehicles.co.uk and advertising the Vehicle for sale;
c. "Customer" means an individual who wishes to inspect a Vehicle at the Aspire Vehicles Ltd;
d. "Reservation" means the process by which a Vehicle is reserved at a retail Customers request in accordance with these terms and conditions;
e. "Order Form" means the standard form used by the Aspire Vehicles Ltd;
f. "Purchase" means the entering into a contract by the completion and signing of an Order Form;
g. "Reservation Fee" means the sum of £100 payable by a Customer in respect of a Vehicle;
h. "Vehicle" means the passenger car (being a car intended for the carriage of passengers) and light commercial vehicles (such as small vans and pick-up trucks and commercial vehicles) that a Customer wishes to be reserve;
i. "Working Day" means any day except Saturday, Sunday or any bank or customary public or statutory holiday in England and Wales;
2. These are the terms and conditions that apply to the exclusion of all others (including any verbal statement or representation) in respect of the Reservation Fee.
3. Reservation is only available to Vehicles advertised on www.aspire-vehicles .co.uk where the Vehicle is advertised with the Reservation Fee option.
4. A Reservation Fee can only be paid online at www.aspire-vehicles.co.uk
5. To secure a Vehicle reservation, the Reservation Fee must be paid by debit or credit card in the name of the Customer. The Customer must also provide their:
a. name;
b. full postal address;
c. telephone number;
d. email address;
e. chosen method of contact;
6. Once the Reservation Fee is confirmed as paid, Aspire Vehicles Ltd will reserve the Vehicle at the Aspire Vehicles Ltd for 96 hours, unless extended under Clause 7;
7. Within 24 hours of the Reservation being confirmed as being paid, the Customer must make an Appointment to view the Vehicle. An Appointment shall be either of:
(a) attending the Aspire Vehicles Dealership to view the Vehicle; or
(b) making an appointment to view the Vehicle within 7 days from the confirmation of the payment of the Reservation Fee.
8. Where a Customer attends the Aspire Vehicles Ltd and decides to Purchase the Vehicle by completing an Order Form, the Reservation Fee will be applied to the purchase price of that Vehicle as shown on the Order Form;
9. Reservation Fee Refunds

If the customer attends the agreed appointment and, having inspected and considered the vehicle, decides not to proceed with the purchase because the vehicle is materially different from its description or does not meet the specification or condition represented by Aspire Vehicles Ltd, the £100 Reservation Fee will be refunded less £5.00 admin fee.

Where the vehicle is as described and the customer decides not to proceed for reasons unrelated to the vehicle, including but not limited to a change of mind, affordability, failure to obtain finance, a change in personal circumstances, or choosing to purchase another vehicle, the Reservation Fee will normally be retained.

The Reservation Fee is paid specifically to reserve the vehicle and to compensate Aspire Vehicles Ltd for withdrawing the vehicle from general sale during the agreed reservation period. The Reservation Fee is not a payment towards the purchase price unless the vehicle is subsequently purchased.

Nothing in these terms affects any statutory rights the customer may have under applicable consumer law. One point I'd consider changing from your existing terms: I would avoid saying the £100 is always non-refundable if the customer changes their mind. The CMA specifically warns that terms making prepayments non-refundable regardless of why a consumer cancels can be unfair.

10. When the Reservation Fee May Be Retained

Where the customer chooses not to proceed with the purchase for reasons unrelated to the vehicle, including a change of mind, affordability, inability to obtain finance, change in personal circumstances, or deciding to purchase another vehicle, Aspire Vehicles Ltd may retain the £100 Reservation Fee.

The Reservation Fee is a payment for removing the vehicle from general sale and holding it for the customer for the agreed reservation period. It is not intended to be a penalty for cancellation.

Where the customer does not proceed because the vehicle is materially different from its description, specification or condition as represented by Aspire Vehicles Ltd, the Reservation Fee will be refunded in accordance with Clause 9.

Aspire Vehicles Ltd will not retain the Reservation Fee where doing so would be inconsistent with the customer's statutory rights or applicable consumer law.

11. Customers may only make one Reservation at any one time.
12. The Reservation Fee is not a deposit, and shall not constitute a contract for the sale or purchase of the Vehicle.
13. A person who is not a party to the terms herein shall not have any rights under or in connection with it and the provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded.
14. These terms and conditions are governed by the laws of England and Wales.
15. The Parties submit to the exclusive jurisdiction of the English Courts.
16. Nothing in these terms and conditions will affect or limit the statutory rights of a consumer.
